We provide software and support services and consultancy services to businesses based in the UK.

For the personal information that we collect we are the data controller.

How do we collect information about you

We obtain information about you if you complete the enquiry form on our website at www.toolvansoftware.com or when you complete and sign a contract with us.

What data do we collect

When you contact us by using the enquiries form at www.toolvansoftware.com:

• we collect your basic business contact information. For example; Name, business address (optional), business phone number and business email address. The information that you provide may contain personal information. For example; your business address may be the same as your personal address.
  

When entering into a contract with us:

• we collect your Name, Business Name, Business Address, Business Phone Number and Business email address. The information that you provide may contain personal information. For example; your business address may be the same as your personal address.
  

We do not collect personal information from you that we do not need to fulfil our contract with you.

What we do with your data (the legal basis and purpose)

If you contact us using the enquiries form on the website:

• we will use the data that you have provided to contact you and answer your enquiry.
  

If you enter into a contract with us:

• we will use your data to enable us to administer and fulfil our contract with you. For example; to let you know when updates are available, when addressing invoices to you for the contracted services etc.
  

• we will use your business email address to enable our Direct Debit service provider “GoCardless” to email you a link to set up an account with them, so that you can set up your direct debit mandate to pay for our services, as required by the contract. When we do this, you will be emailed a link to enable you to set up an account with GoCardless at which point you have control of what information you provide. You may obtain a copy of the GoCardless privacy policy and other information at www.gocardless.com
  

We do not use your data for any automated decision making or profiling purposes.

Who do we share your data with

If you enter into a contract with us, we share your business email address with GoCardless to enable you to set up an account with them.

We do not share your personal data with any other 3rd parties unless we are required to provide the information by law.

We will not share your personal data with any other 3rd party without first seeking your permission.

How long do we keep your data

We are required under UK tax law to keep your basic information records (example; invoices containing name and address details) for a minimum of 7 years.

What are your rights

The right to access personal data held about you

• You can ask us to provide a copy of your personal data that we hold. If you request a copy of your personal data we will provide you with this within 30 days of the request
  

The right for your personal data to be updated

• You can ask us to correct your personal data. If requested to rectify your personal data we will do this within 30 days of the request and confirm completion to you
  

The right to data portability

• You can ask us for a portable copy of your personal data. If you request a portable copy of your personal data we will provide you with this within 30 days of the request
  

The right to object to automated decision making

• We do not carry out any automated decision making
  

The right to be forgotten

• You can ask us to erase your personal data. Where we are not required to keep your personal data for a period of time for legal reasons, (for example; where we have not carried out any invoice transactions or collected any payments) we may be able to erase your personal data. Where we are able to erase your personal data we will do this within 30 days of the request. We will respond to your request within 30 days.

• If you feel that we are processing your personal data in a way that you have not agreed to then you can object to this by contacting us. We will respond to you within 30 days.

What else should I know

We may revise this Privacy Policy from time to time to reflect changes to our business or applicable laws.  The revised Privacy Policy will be effective as of the published effective date. We will notify you of any changes.
